THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.3644 of 2016 ORDER: (per SK,J) Sri Maruthi Jadav, learned counsel representing Sri B.S.Prasad, learned counsel for the petitioner, and Sri G.Vasantha Rayudu, learned counsel for the Bank of Baroda, the respondent, are at consensus that the issues arising in this writ petition are squarely covered by the common order dated 01.03.2016 passed by a Division Bench of this Court in W.P.Nos.3676, 3685, 3766 and 3795 of 2016.

For reasons alike as were stated in the aforestated common order and in terms thereof, the writ petition is allowed on the ground that the respondent bank did not comply with the mandatory requirements of Rules 8 and 9 of the Security Interest (Enforcement) Rules, 2002. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR _____________________________ JUSTI CE GUDI SEVA SHYAM PRASAD Date:05.07.2017 GJ
