THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.32973 OF 2015 ORDER:
The petitioner is a fair price shop dealer of shop No.50, Veeraghattam Village & Mandal, Srikakulam District. While so, a show cause notice was issued by the second respondent on 31.10.2014 in respect of five charges framed against the petitioner. The petitioner submitted reply to the show cause notice on 06.11.2014 and after receipt of the same, the authorization of the petitioner was suspended pending enquiry on 10.11.2014. Thereafter, no enquiry was taken up. Challenging the same, the present Writ Petition is filed. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents. It is clear from the above facts that the petitioner had submitted an explanation and what remained is only enquiry, which the second respondent should have completed by now.
Since the second respondent has not completed the enquiry and passed final orders in respect of the charges levelled against the petitioner, the second respondent is directed to complete the enquiry by giving due opportunity to the petitioner and pass final orders thereon within a period of thirty (30) days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________ (A.RAMALINGESWARA RAO, J) 12th October 2015 Note: Issue CC by three days B/O
