THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24240 of 2015 ORDER:

The petitioner was appointed as fair price shop dealer of Allapuram Village in Krishna District. While so, the Special Deputy Tahsildar inspected the shop on 17.01.2014 and found some variation in the stock. The authorization of the petitioner was suspended on 01.02.2014, challenging which the petitioner filed W.P.No.9471 of 2014. The said Writ Petition was disposed of on 11.04.2014 directing the Sub Collector, Nuzvid, to complete the enquiry pending before him against the petitioner and pass appropriate orders within a period of six weeks. The Sub Collector passed an order on 17.06.2014 canceling the authorization of the petitioner. Against the said order, the petitioner preferred an appeal to the second respondent with a delay of 57 days in filing the appeal. The said delay was condoned by order dated 16.12.

2014 by the second respondent and thereafter the appeal was not disposed of. In view of the non-disposal of the appeal for the last one year, the present Writ Petition is filed. From the above facts it is clear that the appeal preferred by the petitioner is pending before the second respondent. The request of the petitioner for grant of stay of operation of the order of the Sub Collector dated 17.06.2014 was rejected. But, the appeal is not disposed of till today. In the circumstances, the second respondent is directed to take up the appeal, consider and dispose of the same in accordance with law, within a period of sixty days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 04.08.2015 vs
