HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 8 2 3 6 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Karimnagar II-Town Police Station, dated 19.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the petitioner has given a report dated 03.10.2018 to the Commissioner of Police, Karimnagar stating that for the last 20 years they are running Dr.Padmaja Intertility Center in Karimnagar. They did not have any disputes or rivals to any one. Since some days, one Kongera Bhasker Rao and his family harassing him mentally, morally and damaging his reputation in the society. Kongera Bhasker Rao is involved in number of cheating cases.

Kongera Bhasker Rao developed grudge on him, demanding money and blackmailing him and damaging his name in the society. Kongera Bhasker Rao does not do not any work. He is a habitual criminal. He is having criminal record in Karimnagar-I Town Police Station and IITown Police Station and Garla Police Station of Karimnagar District. He already went to jail in some criminal cases. He cheated his own sister in money matter, in which he was convicted and he paid fine of Rs.20,000/ - which was also published in all newspapers. He is a cheater and blackmailer. He is having good relationship with lawyers, registering false cases against him, attacking on him threatening him with dire consequences to kill him. He is demanding money and abusing him in filthy language.

He develops relationship with high level persons, later blackmails and demands money. Kongera Bhasker Rao is registering false cases against him.

The petitioner requested to take necessary action against the said Kongera Bhasker Rao .

It is submitted that the Commissioner of Police, Karimnagar, forwarded the petitioner's report, dated 03.10.2018, to the Inspector of Police, Karimnagar-II Town

Police Station vide C.No.882/ 4282/ G2-1/ 2018, dated 08.10.2018, for enquiry and necessary action. It is submitted that based on the contents of the report of the petitioner, a GD entry was made and after conducting preliminary enquiry, a requisition was filed before the Court of Hon'ble Addl. Judicial Magistrate of First Class, Karimnagar, on 16.11.2018, with a request to accord permission for investigation in the non-cognizable petition and permission is not yet received. It is submitted that after receipt of permission from the Hon'ble Court, appropriate action will be taken on the petitioner's report, dated 03.10.2018.

It is submitted that the petitioner herein without knowing the above facts, filed the present Writ Petition making false and baseless allegations alleging that the Police have not taken any action on his report, dated 03.10.2018.

It is submitted that, as stated above, action has already been taken on the petitioner's report, and as the enquiry revealed that the subject matter of the petitioner's report is relating to non-cognizable offence, a requisition was filed before the Hon'ble Addl. Judicial Magistrate of First Class at Karimnagar, on 16.11.2018, with a request to accord permission for investigation in the non-cognizable petition and permission is yet to be received." Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Station House Officer, Karimanagar I-Town Police Station, dated 19.11.2018. Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs.
