HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.745 of 2015 ORDER:

This petition is filed to withdraw O.P.No.164 of 2015 from the file of Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to Family Court, Vijayawada to be tried along with O.P.No.351 of 2015 pending on the file of Family Court, Vijayawada.

2. Wife filed this petition. According to her affidavit, her marriage was performed with respondent on 13.08.2014 as per Hindu rites and caste customs at Pottipadu Village, Unguturu Mandal and due to adamant behavior of respondent, she was left at her parents' home at Pottipadu and she is now residing along with her mother. She stated that respondent filed O.P.No.164 of 2015 before Family Court, Ranga Reddy for divorce and that she filed O.P.No.351 of 2015 before Family Court, Vijayawada for restitution of conjugal rights. She stated that both the petitions have to be tried together in one Court to avoid conflicting decisions. She further stated that she has no means to meet travelling expenses from Pottipadu village to Ranga Reddy for defending O.P.No.164 of 2015.

5. Considering the reasons stated in the affidavit and the fact that respondent/husband has no objection for transfer and as the two O.Ps filed by husband and wife have to be tried by one Court, request for transfer is considered.

6. Therefore, O.P.No.164 of 2015 is withdrawn from the file of Family Court, Ranga Reddy District at L.B. Nagar and transferred to Family Court, Vijayawada to be tried along with O.P.No.351 of 2015 for disposal in accordance with law.

7. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
