THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO CIVIL REVISION PETITION No.881 of 2014 ORDER:

Heard Sri Ajay Kumar Madisetty, learned counsel for petitioner and Sri B.Mayur Reddy, learned counsel for respondent.

2. This Civil Revision Petition is filed aggrieved by the non-disposal of I.A.No.614 of 2009 filed by petitioner herein O.S.No.648 of 2005 on the file of I Additional Senior Civil Judge, Warangal.

3. It appears that the respondent herein had filed the suit O.S.No.648 of 2005 and obtained an exparte decree on 21-032007 against the petitioner. The petitioner had filed I.A.No.614 of 2009 to condone the delay in filing a petition under Order IX Rule 13 CPC to set aside the exparte decree. Petitioner's grievance is that the said application is not being disposed of.

4. Having regard to the grievance of the petitioner, the I Additional Senior Civil Judge, Warangal is directed to disposed of I.A.No.614 of 2009 in O.S.No.648 of 2005 pending on his file within six (06) weeks from the date of receipt of a copy of this order.

5. The Civil Revision Petition is disposed of accordingly. No costs.

6. As a sequel, miscellaneous petitions pending, if any, shall stand disposed of.
