SMT JUSTICE T.RAJANI CRIMINAL PETITION No.11175 OF 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioners/Respondents seeking to quash the proceedings in D.V.C. No.17 of 2018, pending on the file of the Court of Judicial Magistrate of First Class at Jagtial (for short, 'the trial Court'), registered for the offences punishable under Section 31 of the Protection of Women from Domestic Violence Act, 2005 R/w. Section 498-A of I.P.C.

Heard learned counsel for the petitioners and learned Public Prosecutor, appearing for the 1st respondent - State.

Learned counsel for the petitioner does not press upon the other grounds mentioned in the Petition and he only seeks that a direction be given to the trial Court to dispense with the presence of the petitioners. 4.

Hence, considering the above, this Court opines that the presence of the petitioners before the trial Court may not be insisted upon, unless it is required for the proceedings of the case. But, however, the trial Court can direct the Petitioners/Respondents to be present on those dates of the proceedings in which their presence is required.

Accordingly, with the above direction, the Criminal Petition is disposed of. 6.

As a sequel, miscellaneous petitions if any, pending in this Petition shall stand closed.
