THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11157 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.2, for grant of bail in Crime No.115 of 2018 of the CCS, WCO, Team-VIII Police Station at Hyderabad District, registered for the offences punishable under Sections 406 and 420 read with 34 of IPC. 2.

Heard the learned counsel for the petitioner/A.2 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

The learned counsel for the petitioner would submit that A.1 was granted bail. There are no specific allegations against the petitioner/A.2 and the petitioner/A.2 did not receive any amount from the father of the de facto complainant. All the allegations are false and ultimately, prayed to allow the petition. 4.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/A.2 and ultimately, prayed to dismiss the petition.

The de facto complainant-Somu Srinivasa Ranga Nihar lodged a report with the police stating that S.N.V.R.Mohan Rao is his father; the petitioner/A.2 introduced A.1 to his father and his father was made to pay Rs.2,25,07,000/- through deposits and RTGS from 2014 to till date in the business of gold and diamonds. It is further stated that the petitioner/A.2 received Rs.60 lakhs from the father of the de facto complainant. This petitioner/A.2 is responsible for inducing the father of the de facto complainant to part with huge amount. Further, the petitioner/A.2 is the responsible person for all the happening and ultimately, his father is cheated.

As per the record, A.1 was granted regular bail after completion of statutory period of 60 days. The present petition is filed under Section 438 Cr.P.C. There are serious allegations against the petitioner/A.2. The gravity of offence is also high. Huge amount was received by him. He is one of the main accused in this case. His release under Section 438 Cr.P.C. would hinder the investigation. There is possibility of causing disappearance of the material witnesses and also winning over the witnesses. Hence, it is not a fit case to allow the petition.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
