This writ petition is filed seeking writ of mandamus declaring the action of the respondents 3 and 4 in trying to demolish/remove Dhobhighat of the petitioners situated at beside Moosi River Bank in Sy.No.112/2, Chadharghat, Hyderabad without following due process of law including payment of compensation or show alternate place as illegal and arbitrary and consequently to direct the respondents not to demolish/remove dhobhighat of the petitioners. It is the case of the petitioners that they are belonging to Washermen community and they have been carrying on their activity at Moosi River Bank, Chadhatghat, Hyderabad.
It is stated that their activity is being affected since railway line is laid in the said lands and that without paying any compensation, they are being deprived to carry on their activity of washing the clothes in the said place. Aggrieved by the same, the present writ petition is filed. Sri K.Vivek Reddy, learned Standing Counsel takes notice on behalf of the 4th respondent-Hyderabad Metro Rail Project and produced letter dated 17.04.
2014, wherein it is categorically stated that part of the Dhobhighat located at Musi river near City Model School, Chaderghat is being affected in Metro Rail alignment and after lot of negotiations Dhobis have cooperated with the HMR for taking up Metro Rail works in the above location subject to reconstruction of Dhobighat in the adjoining place so as to continue their livelihood and that a copy of site plan of the subject area is prepared and furnished for taking further action for construction of Dhobighat along with required facilities in the area as "Rehabilitation Measure".
Heard learned counsel for the petitioners, learned Government Pleader for Municipal Administration and learned Government Pleader for Revenue, Sri C.Damodar Reddy, learned Standing Counsel for 3rd
respondent and Sri K.Vivek Reddy, learned Standing Counsel for 4th respondent.
Recording the submission of the learned Standing Counsel for the 4th respondent and also in view of the letter dated 17.04.2014, which is placed before this Court, this writ petition is disposed of. There shall be no order as to costs.
