THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41931 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring order No.297/L1/RK/2016, dated 25.09.2016, passed by the third respondent as illegal and arbitrary, and consequently to set aside the order impugned.
Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner lodged the complaint against his wife and mother-in-law alleging that they filed a forged letter in the Family Court, Ranga Reddy District and as such, to take necessary action against them. However, the third respondent passed an order, dated 25.09.2016 stating that it is not related to his jurisdiction and as such, he could not initiate any action on the petition of the petitioner. The learned counsel further submits that the alleged offence has been committed in the territorial jurisdiction of the third respondent, and as such, the order impugned may be set aside.
Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the third respondent to register the complaint of the petitioner if it discloses any cognizable offence, and transfer it to the police station concerned, and that the police station concerned is directed to conduct effective investigation and file final report, if any, in accordance with law.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 02.12.2016 pln
