Heard counsel for petitioner and Assistant Government Pleader for Revenue for respondents 2 to 5.
The inaction of respondents 4 to 6 in taking action on the representations of petitioner dated 10.01.2011, 28.01.2011 and 19.06.2011 despite communication made by the District Collector/ 3rd respondent to the Tahsildar/ 5th respondent vide reference L.Dis.No.E4/ 328/ 2011 dated 12.10.2011 for removal of encroachments by respondents 7 and 8 over the property vested with 6th respondent, is complained as illegal, arbitrary and violative of principles of natural justice.
Having regard to the nature of grievance the petitioner has, without entering into merits of the matter, the writ petition can be disposed of by this order.
The writ petition is, accordingly, disposed of with liberty to petitioner to represent to respondents within two weeks from the date of receipt of a copy of this order. Respondents 5 and 6 are directed to dispose of the said representation and if encroachment of land in R.S.No.133/ 5 of Neppalli Village, Kankipadu Mandal, Krishna District, is noticed, action in accordance with law is taken. The respondents are directed to communicate to petitioner the decision taken on the representations of petitioner within two months thereafter. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, also stand disposed of.
