THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.3851 OF 2013 ORDER:

This revision is filed by the petitioners/ defendants 1 and 2, aggrieved by the order dated 01.07.2013 in I.A.No.2770 of 2013 in A.S.No.153 of 2013 passed by the Chief Judge, City Civil Courts, Hyderabad.

Heard both sides.

It is impugning the trial Court's decree dated 23.04.2013 in O.S.No.2645 of 2010, an appeal in A.S.No.153 of 2013 is preferred, wherein I.A.No.2770 of 2013 is filed under Order XLI Rule 5 C.P.C. to suspend the operation of the trial Court's decree and judgment and the same, by a contest order, running in 12 pages with 8 paras ended in dismissal on 01.07.2013. It is impugning the same, present revision is filed. 4.

All through from perusal of the docket, there is no any interlocutory order passed by this Court.

Having regard to the above, there is nothing to keep the revision pending, much less, to go into the merits by sitting against the dismissal order of the stay petition of the revision petition pending disposal of the A.S.No.153 of 2013, but for, directing the lower appellate Court to dispose of the appeal on

merits as early as possible, preferably, within four months from the date of receipt of copy of this order.

With the above direction, the Civil Revision Petition is disposed of.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
