HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.8604 OF 2002 ORDER:

This writ petition is filed challenging the award dated 6.1.2000 passed in I.D.No.C.13/1998 by the Industrial Tribunalcum-Labour Court, Warangal. 2.
When this matter was listed on 15.4.2014, this Court passed the following order:
"The learned Counsel for the petitioner is permitted to take out personal notice to un-served respondent No.1 by RPAD within eight weeks from today and file proof of service, failing which, the writ petition shall stand dismissed as against un-served respondent, without any further reference to the Court."

Perusal of the material on record discloses that the petitioner has not filed any proof of service. In view of the same, this writ petition is liable to be dismissed.

Further, it has been brought to the notice of this Court that the 1st respondent expired.

Accordingly, the Writ Petition is dismissed. It is made clear that if the legal representatives of the 1st respondent-workman are aggrieved by non-implementation of the award passed by the Tribunal, they are at liberty to file execution petition claiming
benefits arising out of the said award including interest to which they are entitled. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
