This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C., challenging the order, dated 29-11-2016 in Crl.M.P.No.3994 of 2016 in C.C.No.573 of 2015 on the file of the Additional Judicial Magistrate of I Class, Avanigadda.

Learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the Criminal Revision Case with a liberty to file fresh application under Section 70 (2) Cr.P.C. by personally attending before the trial Court. Permission is accorded.

Accordingly, the Criminal Revision Case is dismissed as withdrawn granting liberty as prayed for. If the petitioner files an application under Section 70 (2) Cr.P.C. by personally attending before the trial Court, the trial Court is directed to dispose of the same on the same day in accordance with law. Miscellaneous petitions, if any pending, in this Criminal Revision Case shall stand closed.
