THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.13246 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking following relief:
"to issue Writ of Mandamus declaring the action of the respondents in illegally interfering with the developmental activity by the petitioners over the land admeasuring Acs.12-37 guntas in Sy.No.54, situated at Jalpally village and Gram Panchayat, Saroornagar Revenue Mandal, Ranga Reddy District, as being arbitrary, illegal, unconstitutional and in violation of the petitioners rights guaranteed under Articles 14, 19 and 300-A of the Constitution of India."
Heard Sri Avinash Desai, learned counsel for the petitioners and learned Government Pleader for Home for the respondents. Today, when the matter is taken up, learned Government Pleader has placed on record the written instructions furnished by the Station House Officer, Pahadishareef Police Station, Cyberabad. In the said instructions it is stated that the petitioners herein were involved as accused in Crime No.419 of 2009, dated 16-10-2009 for the alleged offences under Sections 447, 427 and 506 of IPC on the file of Pahadishareef Police Station with regard to Sy.No.54 of Jalpally village and Grampanchayat, Sarrornagar Madal, Ranga Reddy District and the said case was referred as civil nature on 20-01-2012 before the Court of XIV Metropolitan Magistrate, L.B. Nagar.
The said instructions further state that on the complaint of one Syeda Akber Zamani a case in Crime No.40 of 2015, dated 09-02-2015 for the offences under Sections 447, 427 and 506 of IPC on the file of Pahadishareef Police Station, with regard to Sy.No.54 of Jalpally village and Grampanchayat, Sarrornagar Madal, Ranga Reddy District has been registered against one S. Krishna Reddy and others. The said instructions further denied interference by police with the developmental activity of the petitioners for the land in Sy.No.
Ac.12-37 guntas situated at Jalpally village and Grampanchayat, Sarrornagar Madal, Ranga Reddy District. It is further stated that as a part of investigation in the criminal cases, the respondents visited the scene of offence and the police are maintaining the law and order to keep the peace and tranquility in the area.
In view of the above instructions and by recording the same, this writ petition stands closed. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
