Petition under Section 438 of Cr.P.C. praying that in lhe circumstances stated in the grounds filed therein, the High Court may be pleased to grant the petitioner Anticipatory Bail in terms of SEC 438 Cr.Pc in the event of his arrest by the Respondent. ,- The Petition coming on for hearing, upon perusing the petition and the grounds filed therein and upon hearing the arguments of Sri D.S.N.V.Prasad Babu, Advocate for the Petrtioner and of the Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:

ORDER

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is the accused, in Crime No.263 of 2015 on the file of Hanuman Junction Police Station, Krishna District. The offences alleged are under Sections 143, L47, l4B, 286, 332,347 r/w 149 IPC.

Heard the counsel For the petitioner and the Public Prosecutor appearing for the respondent.

3. The counsel for the petitioner submits that earlier bail petition viz., Crl.P.No.10420 of 2018 was dismissed against this petitioner only on the ground that he is a rowdy sheeter. 4.

A perusal of the order shows that this court observed that wv)r the offences alleged are bailable offences ad that A1 is a rowdy sheeter involved in several crimes. However, by virtue of the order, dated 22.LL.2018, in W.P.No 785 of 2018, this court 't'-, allowed the petition and set aside e rowdy sheet opened rh against the petitioner.

Hence, in the.above circumstances, this court opines that this is a fit case for granting anticipatory bail. 6.

Accordingly, the Criminal Petition is allowed.

l The petitioner is directed to surrender before the Station House Officer, Hanuman Junction Police Station, Krishna District, within 15 days from the date of this order. On such surrender, the petitioner shall be released on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty I

thousand only) with two sureties each for a like sum each to the Lt satisfaction of the said Station House OFficer. Further, on such release, the petitioner shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under:

i) The petitioner shall make himself available for interrogation by a police officer as and when required. ii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts oF the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

iii) The petitioner shall not leave India without the previous permission of the Court.

As a sequel, the miscellaneous applications, if any pending, shalt stand closed.
