HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.1365 OF 2015 ORDER:

The petitioners pray for Mandamus declaring the action of 4th respondent in refusing to receive sale deeds presented for registration by the petitioners for the land in Survey Nos.133/1, 133/6, 133/7, 133/10, 134/2, 135/2 and 136/2 at Tallavalasa Village, Bheemunipatnam Mandal, Visakhapatnam District, as illegal and amounts to refusing to exercise the jurisdiction/duty cast on the 4th respondent. The petitioners in support of the assertion of having presented the documents, place along with the writ affidavit executed sale deeds, payment of stamp duty and registration fee, and contend that the documents have been in fact, presented for registration and the 4th respondent refused to receive the documents for registration.

On instructions, the learned Government Pleader for Revenue submits that the reasons stated in the affidavit for refusing to receive the documents are incorrect and the 4th respondent never refused to receive the documents. If the documents are presented by the petitioners, 4th respondent will receive, process the documents for registration in accordance with the provisions of the Registration Act and stamp duty and appropriate orders are passed. The stand of the 4th respondent is placed on record and the writ petition is disposed of accordingly. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. ___________ S.V.BHATT, J Date:02.02.
