2015-02-19Vilas V.Afzulpurkar2 pages

HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.1992 of 2015 ORDER:

Heard.

The petitioner alleges illegal interference by respondent No.2 with respect to his property bearing door No.11-1-1448/1/A situated at Ward No.11, Kanteshwar, near Narasimha Apartments, Nizamabad. The petitioner states that at the instance of the 4th respondent, who is a neighbouring plot owner, the 2nd respondent is frequently telephoning and threatening him to vacate from the property in question. The present writ petition is, therefore, filed for a Mandamus as sought for. Learned Government Pleader has received instructions from the 2nd respondent, wherein while denying the petitioner's allegations it is specifically stated that the 2nd respondent never called the petitioner over telephone nor threatened him with dire consequences. The 2nd respondent also states that he does not know either the petitioner or the 4th respondent and the petitioner is unnecessarily involving the 2nd respondent.

In view of the said instructions, the allegation of the petitioner that the 2nd respondent, at the instance of the 4th respondent, is interfering with his property in question is clearly unsubstantiated, as the 2nd respondent states that he does not even know the petitioner and the 4th respondent. Hence, no further orders are necessary in this writ petition.

Accordingly, the writ petition is disposed of. No order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
