THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1501 OF 2014 ORDER:

This Criminal Petition is filed by the accused No.4 & 5 under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C.NO.1211 of 2012 pending on the file of X Metropolitan Magistrate, Cyberabad at Malkajgiri for the offences under Sections 498-A, 323 IPC and Sections 3 & 4 of Dowry Prohibition Act.

The Criminal Petition was already dismissed as withdrawn as against petitioner No.1-A.4 as per the orders of this Court dated 17.2.2014.

After arguing for some time, the learned counsel for the petitioner confined his argument to the extent of dispensing with the presence of the petitioner No.2 before the trial Court. Being the offence alleged against the petitioners under Section 498-A IPC, the question of identity of petitioner No.2 before the trial Court does not arise.

In the circumstances, the presence of the petitioner No.2A.5 before the trial Court is dispensed with except on the dates so specifically the trial Court insists for his appearance. The petitioner No.2 is directed to be represented by a counsel on all hearing dates.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
