HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4135 of 2015 ORDER:

This is a petition seeking bail for the petitioner/accused No.2, who is alleged to have committed the offences punishable under Sections 147, 148, 353, 341, 307 and 379 r/w.149 of I.P.C. and Section 20 (1)(c)(iii)(iv) and (x) of A.P. Forest Act, 1967, Rule 3 of Red Sandalwood and Red-Sanders Wood Transits Rule, 1989 and Section 30 of Indian Arms Act, in Crime No.66 of 2014 of Bhakarapet Police Station, Chittoor District. Heard the arguments of both sides.

Perused the material on record.

The case of prosecution, in brief, is as under:- On 27-06-2014 at about 5.30 p.m. on credible information, the police had gone to Bhakarapet Ghat Road, near B.V. Reddy Guest House, in Seshachalam Reserve Forest Area, Chinnagottigallu Mandal and found some persons with axes cutting Red Sander Wood, and they confessed that the petitioner/A2 along with A1 and A3 was involved in transportation of Red Sander Wood. Taking into consideration the gravity of the offence, the manner in which it is committed and the surrounding facts and circumstances and the fact that case is yet to be committed to the Court of Sessions, it is not desirable to release the petitioner/A2 on bail at this juncture. Hence, there are no merits in the petition and the same is liable to be dismissed. However, once the case is committed to the Court of Sessions the petitioner/A2 is at liberty to move the bail application afresh.

The Criminal Petition is accordingly dismissed. ________________
