HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.21974 of 2016 ORDER:

The writ petition is filed with the following prayer: " To issue writ or direction preferably writ of mandamus declaring the action of the respondent in not granting pension to the petitioner from the date of application of her husband under "Swatantra Sainik Samman Pension Scheme" and granting pension only with effect from 15-02-2010, as illegal and arbitrary. Heard learned counsel for the petitioner.

Learned counsel representing Assistant Solicitor General submits that pension was granted to the petitioner in pursuance of the directions given by the Government of India on 17-03-2010 with effect from 15-02-2010 and the petitioner kept quite for six years, again seeking payment of freedom fighters pension from the date of application. Nothing is mentioned by the petitioner as to why she has kept quite for all these years. A perusal of the proceedings dated 17-032010 goes to show that the petitioner was granted pension by giving benefit of doubt from 2010 onwards.

In view of the above facts and circumstances, it is understood that the petitioner accepted the pension and kept quite for six years and now seeks pension from the date of application. In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 13-07-2016 Nvl
