THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.30014 OF 2015 O R D E R :

Heard.

The petitioners complain that they are the original owners and possessors of land admeasuring Ac.01.05 cents in Survey No.29/8 situated at Gunadala Village, Vijayawada Urban, Krishna District. Some third parties have created several registered documents on the basis of fake title and the said documents were registered by the Sub-registrar and District Registrar, Vijayawada.

The petitioners made a representation to respondents 2 to 4 as well as to respondents 5 and 6 on 17.07.2015 requesting them to enquire into the matter. Alleging inaction on the part of the respondents, the present writ petition is filed.

I am unable to see what action any of the said respondents can take, as neither of them is empowered to adjudicate upon the genuineness of the documents or the title between the parties. Hence, a direction to consider and dispose of the writ petition, as sought for by the learned counsel for the petitioner, would be highly misplaced as the powers of the registration authority are limited for ensuring compliance of the Stamp Act and the Registration Act and the issue of genuineness of the transaction or the title documents produced by the parties cannot be gone into by the registration authorities. Similarly, revenue authorities also cannot adjudicate upon the title of the persons including the petitioners as well as the vendors/vendees under the said documents. The relief sought for in the present writ petition is misconceived. Hence, the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
