This writ petition is filed challenging the impugned order in Rc.No.B.209/2018, dated 08-10-2018 cancelling the assignment in favour of the petitioner vide proceedings in D.A.R.Dis.No.44/1415 dated 08-12-2005.
Learned counsel for the petitioner submits that the impugned order is passed in violation of principles of natural justice, as no notice was issued to the petitioner before passing the same.
Learned Assistant Government Pleader for Revenue produced written instructions stating that notice is served on the father of the petitioner, but the same is disputed by counsel for the petitioner saying that the petitioner is a married person and living separately.
Heard learned counsel for the 5th respondent. In view of the above facts and circumstances, without expressing any opinion on merits, only on the ground of violation of principles of natural justice, the impugned order is set aside. The 3rd respondent is directed to reconsider the issue, in accordance with law, after giving opportunity of hearing to the petitioner and other affected parties, within a period of four weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
