HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 20460 OF 2015 O R D E R :

This writ petition is filed by the petitioner to declare the inaction of the respondent No.2 against respondent No.3, about the property bearing survey No. 1030/A/1, H.No. 30-2-483/1 of village Madikonda Mandal, Hanamakonda, Warangal district, as illegal, arbitrary, unconstitutional and against the provisions of Article 14 and 21 of the Constitution of India and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. This writ petition is filed in the year 2015 and in view of the changed circumstances and after a lapse of so many years, it is reasonably presumed that no cause of action survives, since no steps have been taken from 2015 till date for pursing the writ petition seeking the relief prayed therein.

3. Sri Srikanth Reddy, learned Government Pleader for Home [TG] submits that nothing survives in this writ petition at this stage and the alternative remedy is available to the petitioner to approach the civil court in pursuance of the injunction order granted, since this matter pertains to a civil dispute no relief can be granted under Article 226 of the Constitution of India, giving liberty to the petitioner to pursue appropriate remedy under law, if so advised.

4. With the above observation, the writ petition is disposed of. No costs.

5. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
