HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3702 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.28 of 2015 of Makavarapalem Police Station, Visakhapatnam for the offences punishable under Sections 313, 376, 417, 420, 498 and 506 I.P.C and Section 3(1)(xii) of the Scheduled Castes and Scheduled Tribes (Prevention of Attrocities) Act, 1989.

2) Heard, the learned counsel for Petitioner and the 1st respondent-State represented by the learned Public Prosecutor.

3) As there is no material and no grounds including the abnormal delay in reporting the grounds about seven years, to admit the application for quashing the proceedings, the present application is disposed of giving liberty to the petitioner/accused to surrender before the learned Magistrate concerned and file a memo of surrender with regular bail application before the Special Judge for trial of Scheduled Castes and Scheduled Tribes (PoA) Act cases with notice to the Special Public Prosecutor concerned and in such an event, the learned Special Judge shall consider for granting bail with necessary conditions on the same day, if not even on the next day.

4) With the above observations, the criminal petition is disposed of.
