HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38729 of 2018 ORDER:
The petitioner challenges the assignment proceedings dated 25-09-2018 allotting the land admeasuring Ac.2-00 guntas in sy.No.188/2 of Narsingi village, Gandipet Mandal, Ranga Reddy District to the 5th respondent on lease basis by the Government.
Learned counsel for the petitioner submits that the petitioner and others i.e. B.Lakshma Reddy and B.Jagannadha Reddy were allotted land admeasuring Ac.1-11 guntas and Ac.230 guntas in sy.Nos 186 and188 of Narsingi village and inspite of the same, the 5th respondent is allotted land in sy.No.188/2 and the petitioner filed objections. Aggrieved by the same, the present writ petition is filed.
Learned Special Government Pleader appearing for official respondents submits that since the subject land under allotment vide letter dated 25-09-2018 is a government land and the same was allotted to the 5th respondent and possession was taken on 25-09-2018.
In this case it is to be seen that the petitioner claims the subject land and whereas the respondent-Government claims the same to be the Government land and allotted to the 5th respondent by way of impugned proceedings. These disputed
questions of fact cannot be decided in the writ petition as such, this Court is not inclined to entertain the writ petition. Accordingly, this writ petition is disposed of granting liberty to the petitioner to avail alternative remedies available under law. However, this order will not preclude the respondent-authorities from considering the representation of the petitioner and taking appropriate action in accordance with law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
