THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11196 OF 2018 ORDER:

This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, for grant of bail in Crime No.377 of 2018 of Prohibition and Excise Police Station, Dhoolpet, Hyderabad, registered for the offence punishable under Section 8(c) read with 20(b)(ii) of NDPS Act. 2.

Heard the learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

Learned counsel for the petitioner/A.1 would submit that the petitioner is an innocent person and falsely implicated in this case and ultimately, prayed to allow the petition. 4.

Learned Additional Public Prosecutor submits that apart from the above Crime, Crime No.216 of 2018 of Mangalhat police station and GOR No.326 of 2018 of Dhoolpet Excise police station and other similar cases are pending against the petitioner/A.1 and investigation is in progress.

As per the material placed on record, 1.200 kgs of ganja alleged to have been seized from the possession of the petitioner/A.1 and A.2 and they were remanded to judicial custody on 26.09.2018. The investigation is in progress. There are no circumstances to consider the application of the petitioner/A.1. 6.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
