THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1516 of 2013 ORDER:
The order, violation of which is alleged in this Contempt Case, required the respondents to examine the petitioners' application in accordance with Rule 9-L of the Rules as notified in G.O.Ms.No.154 dated 15.11.2012, to pass an order thereupon in accordance with law, and communicate their decision to the petitioners within a period of three weeks from the date of receipt of a copy of the order. A copy of the order was received by the respondents on 02.07.2013. They were, therefore, required to comply with the order within three weeks thereafter i.e by 23.07.2013. While the respondents claim that an order was passed on 16.09.2013, the petitioners allege that the order was communicated to them only on 16.10.2013 and the proceedings were ante dated to 16.09.2013. The fact that a copy of the order was served on 02.07.2013 is not in dispute.
Even if 16.10.2013 is said to be the date of communication, the delay in complying with the said order is less than 50 days. As the delay in compliance is not so inordinate as to justify punishing the respondents under the Contempt of Courts Act, the Contempt Case is closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs. ______________________________ RAMESH RANGANATHAN, J 30th October 2015.
