This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners-A.2 to A.9 in Cr.No.18 of 2015 of M.R.Palli Police Station, Tirupati UPD, Chittoor District, registered for the offences punishable under Sections 324,448 and 379 of IPC read with 34 of I.P.C. praying to quash the proceedings in said crime.
2. Heard the learned counsel for the petitioners/A.2 to A.9 so also the learned Public Prosecutor representing State-1st respondent before admission and before ordering notice to the 2nd respondent/defacto-complainant and perused the material on record.
3. As the material falls short for this Court to admit the application under Section 482 of Cr.P.C. to quash the proceedings in the above crime, the Criminal Petition is disposed of, as the facts otherwise admits the petitioners' entitlement for regular bail by giving liberty to the petitioners to surrender before the learned Special Judge and move an application for regular bail with a notice to the Special Public Prosecutor concerned and in such an event, the learned Special Judge can hear and pass orders by granting bail with necessary conditions preferably on the same day or next day. Any further remedy is left open to the petitioners in the event of police filing final report, the learned Special Judge shall consider to dispense with the presence of the petitioners pending investigation.
4. Consequently, miscellaneous applications, if any, pending in this Petition shall stand closed.
