THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.8375 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- "...to issue order or orders, direction or directions, Writ or Writs, particularly one in the nature of Writ of Mandamous declaring the action of 3rd Respondent in not taking an action on the 4th and 5th respondents for committing the theft of petitioners Vehicle bearing No. AP 16 CF 9099 Ford Classic and keep in their illegal custody is illegal, arbitrary, and violation of article 300-A of Constitution of India consequently direct the respondents to registrar a crime on the complaint dated 31-01-2014 lodged by the petitioner, investigate into the offence and take appropriate action against Respondent Nos.4 & 5 and to pass such other orders as are necessary in the interest of justice."

Learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions, dated 18.11.2019, issued by the Sub-Inspector of Police, Panjagutta Police Station, Hyderabad City.

From the perusal of the said written instructions, it is revealed that pursuant to the complaint lodged by the petitioner, a case in Crime No.392 of 2014 for the offences under Sections 406 and 420 IPC was registered on 30.03.2014. During the course of investigation, witnesses were examined and their statements were also

recorded. After completion of investigation, the case was referred as 'lack of evidence' and final report was filed before the XIV Additional Chief Metropolitan Magistrate, Nampally, on 27.02.2015. 5.

In view of the above said facts and circumstances, this Court is of the opinion that no further cause would survive in the writ petition, since final report is already filed.

Accordingly, the writ petition is closed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
