HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Civil Revision Petition No. 1415 of 2016 ORDER:
This revision is filed by the petitioner-wife in H.M.O.P.NO.82 of 2012 on the file of the learned Principal Senior Civil Judge, Chittoor against the respondent-husband seeking direction to the trial Court for early disposal of said petition (HMOP No.82 of 2012). The revision petitioner who is wife of the respondent filed O.P.No.82 of 2012 for divorce way back in June, 2012. Counter of the respondent also filed on 23.08.2013 and one of the contentions in the counter is that he is ready to give divorce, however he is entitled to compensation for the mental agony he suffered in the hands of his wife/ the revision petitioner besides returned all the jewellery. The matter is, as per the docket proceedings, practically with no progress coming simply as called on.
The respondent having been personally permitted to take notice unclaimed from the door lock and notice service is held sufficient and hence taken as heard and perused the record.
In the facts of the case, it is just to direct the lower Court to give preferential disposal at least in four (4) months from the date of receipt of the order.
In the result, the revision is disposed of with the above direction. No costs. Consequently, pending miscellaneous petitions in this revision, if any, shall stand closed.
