Aggrieved by the concurrent findings of fact with respect to possession of the subject property in favour of the respondents and the decree of injunction granted to them based on such findings, the defendants in the suit filed this Second Appeal.

At the hearing, the learned Counsel for the appellants/defendants, submitted that OS.No.9 of 2010 filed by his clients for declaration of title and permanent injunction in respect of the subject property is pending. In the light of the above fact and having regard to the concurrent findings of fact regarding the respondents' possession over the subject property, no substantial questions of law arise in this Second Appeal. The Second Appeal is, accordingly, dismissed, however, without prejudice to the right of the appellants to pursue OS.No.9 of 2010.
