THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1667 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The present Criminal Petition came to be filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking enlargement of the petitioner/accused No.2 on bail in Sessions Case No.126 of 2015 on the file of the I Additional Sessions Judge, Rajahmundry, which arose out of Cr.No.118 of 2015 of Gollaprolu Police Station, East Godavari District, registered for the offence punishable under Section 8(c) read with 20(b)(II)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985.

The allegations in the charge sheet show that on prior information about transportation of Ganja, Inspector of Police along with mediators arrested accused Nos.1 and 2 on 10.08.2015 at 6:00 P.M., after following due procedure under NDPS Act with the assistance of LWs.4 to 9 and 15, as the accused were found in possession of 5 bags of Ganja, containing 125 Kgs., of Ganja worth Rs.12,50,000/-. On enquiry, the accused disclosed that they were about to transport the Ganja bags to Vijayawada or Tamilnadu States for selling them at higher rate. Basing on the said search, police seized the contraband and also the vehicle, which was used for transportation of the contraband. After completion of the investigation, police filed charge sheet.

4. A perusal of the averments in the charge sheet clearly disclose the huge quantity of Ganja was seized from the petitioner and another accused. That being the position, the request of the petitioner that the family of the petitioner is thrown on streets because of the detention of the petitioner cannot weigh with the Court for grant of bail. Apart from that, record also discloses that on 04.01.2016 this Court rejected the request of the petitioner in Criminal Petition No.13914 of 2015.

5. Hence, I am not inclined to grant bail to the petitioner at this stage.

6. Accordingly, the Criminal Petition is dismissed. However, the trial Court shall complete the trial in Sessions Case No.126 of 2015 as expeditiously as possible preferably within a period of three (03) months from the date of receipt of a copy of this order.
