HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38278 OF 2018 ORDER :
This writ petition is filed challenging the proceedings No.B/1146/2011, dated 30.07.2018 issued by the 3rd respondent under Section 6 of the A.P.Land Encroachment Act, 1905, whereby the Village Revenue Officer, Jillelguda Village, is directed to carry out eviction and to take possession of the house of the petitioner in Plot No.772, bearing H.No.5-77/97, in Survey No.119 of Jillelaguda Village, Ranga Reddy District.
Learned counsel for the petitioner submits that without any prior notice and without following due procedure, the respondents, straight away issued impugned notice asking the petitioner to vacate the premises.
Heard learned Assistant Government Pleader for Revenue who submits that the impugned notice can be treated as show cause notice and petitioner can file explanation.
In view of the facts and circumstances, the writ petition is disposed of directing the petitioner to file explanation within four weeks from today, treating the impugned notice dated 30.07.2018 as show cause notice. On such explanation, the 3rd respondent is directed to consider the same and pass
appropriate orders after giving opportunity of hearing to the petitioner. Till passing of orders, there shall be stay of dispossession of the petitioner. No order as to costs.
