HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION Nos.4328 and 4756 of 2015 COMMON ORDER :
Since the issue involved in both these civil revision petitions is one and the same, they are heard together and being disposed of by this common order.
2. C.R.P.Nos.4328 and 4756 of 2015, under Article 227 of the Constitution of India, are filed by the petitioner/plaintiff aggrieved by the common order and decrees dated 02.05.2015 in I.A.Nos.1710 and 2112 of 2013, respectively, in O.S.No.112 of 2012, passed by the III Additional Chief Judge, City Civil Court, Hyderabad, allowing the applications i.e., (i) I.A.No.1710 of 2013 filed by defendant Nos.4 to 8; and (ii) I.A.No.2112 of 2013 filed by defendant Nos.1 to 3; both under Order IX Rule 13 C.P.C., r/w. Section 151 of C.P.C., seeking to set aside the exparte decree dated 30.07.2012 in O.S.No.112 of 2012 passed against them.
3. When the matters are taken up for hearing, the only request made by the learned counsel for petitioner/plaintiff in both the revisions is to direct the Court below to dispose of the suit by fixing a time-frame.
4. Having regard to the reasons recorded by the Court below in the impugned common order dated 02.05.2015, this Court is of the view that there is no case made out in these revisions, warranting interference by this Court under Article 227 of the Constitution of India. However, in view of the request made by the learned counsel for petitioner/plaintiff, I deem it appropriate to dispose of these civil revision petitions directing the Court below to dispose of the suit in O.S.No.112 of 2012, as expeditiously as possible.
5. Subject to the above direction, both these civil revision petitions are disposed of, at the admission stage. As a sequel, miscellaneous
petitions pending, if any, in these revisions shall stand closed. No order as to costs.
