THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 22836 of 2016 ORDER:

The present writ petition is filed with the following prayer: "For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon'ble Court may be pleased to issue an order, writ or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the second respondent in taking any action on petitioner's representations dated 19th and 30.06.2016 as illegal, arbitrary and unconstitutional and consequently direct the second respondent to take action on the said representations as per the provisions of GHMC Act, 1955, in accordance with due process of law at the earliest in the interest of justice and grant such other relief or reliefs as this Hon'ble Court may deem fit and proper under the circumstances of the case."

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the second respondent to dispose of the representation dated 30.06.2016, made by the petitioner seeking action against the illegal and unauthorized construction made by one K.Venkataiah over the land in Survey No.625/E of Bheemaram Village, Hasanparthy Mandal, Warangal District. Learned Standing Counsel does not dispute the same, provided the said representation is pending. Having regard to the above circumstances and without going into merits of the case, the present writ petition is disposed of directing the second respondent to dispose of the representation dated 30.06.2016, made by the petitioner, within a period of four weeks, in accordance with law, if it is still pending consideration.

It is needles to mention that before passing any orders, the authorities shall hear the petitioner and the affected parties.
