HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38302 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 2 and 3 in granting permission to construct the house bearing No.5-11/5/6, near Saibaba Temple, Aravind Nagar Jagityala Town, Jagityala Town and District to the 4th respondent without considering the representation of the petitioner dated 14.6.2018, as illegal and arbitrary.

When the matter is taken up for hearing, learned counsel for the petitioner submits that the permission has already been granted to the 4th respondent and in that view of the matter, it is for the petitioner to challenge the same before the appropriate authority. Having regard to the facts and circumstances of the case, the writ petition is disposed of giving liberty to the petitioner to challenge the permission granted to the 4th respondent before the appropriate authority, if he is otherwise entitled. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
