HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 8 2 9 1 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Pet Basheerabad Police Station, dated 24.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "One Sri Gaddam Koteswar/ 6th respondent herein has approached the Police of Pet Basheerabad Police Station and lodged a complaint on 07.09.2018 stating that he is an Ex-Serviceman and he purchased plot No.178 in Sy.No.1 admeasuring 178 Sq.Yds., and also registered the said plot and along with him one Mr.Modi Kiran Kumar has also purchased a plot No.3 admeasuring 180 sq.yds., and when they were arranging boundary stones for their respective plots, one Mr.

Narsima Reddy, Vikram Reddy, Mahipal Reddy came there and obstructed them, for which they filed a civil suit and obtained injunction orders in I.A.No.1011/ 2018 in O.S.No.209/ 2018 and even though he got injunction orders from the Hon'ble Court Mr.Ranga Raju (petitioner herein) from whom the complainant sold the plot and the above named persons are interfering with their plots and hence requested the police to summon them and do justice to them.

Upon receipt of the said petition, an entry was made into the Station general Diary on 07.09.2018 itself after enquiry action will be taken.

Since the dispute the complainant/ 6th respondent herein is purely civil in nature and hence no action whatsoever was taken on the said complaint and advised him to seek his redressal in a competent Court of law. As of now, no case whatsoever was registered on the above complaint against the petitioner herein or any one.

It is humbly submitted that the dispute of the petitioner herein as well as the unofficial respondents

herein is purely civil in nature and hence no action was taken on the complaint of the 6th respondent herein. It is pertinent to submit that on coming to know the lodging of the complaint by the 6th respondent herein, to prevent the police from taking any action, the petitioner rushed to this Hon'ble Court and filed the present Writ Petition.

I humbly submit that at any point of time, this respondent never summoned the petitioner nor interfered with the subject lands of the petitioner herein. I submit that the allegation of the petitioner that this respondent is interfering in the civil dispute and harassing him by frequently calling him seeking his presence in demand for settlement at the behest of the respondents 8 and 9 herein is absolutely false and hence denied.

I submit that having bore grudge against the unofficial respondents herein, the petitioner made false and frivolous allegations against the respondent which are far away from truth. I submit that the petitioner is not at all required in any case registered on the file of Pet Basheerabad Police Station and this respondent never summoned the petitioner nor ask him to settle the matter with the unofficial respondents and also did not act at the instance of the unofficial respondents herein as alleged." Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Pet Basheerabad Police Station, dated 24.10.2018, with a further direction to the respondents herein not to meddle with the civil disputes unless the same is permitted by law.
