THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13108 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioner/accused Nos.3 and 5 seek to quash the proceedings in Cr.No.396 of 2013 on the file of Miyapur Police Station, Cyberabad, whereunder the petitioners and three others were charged for the offences under Sections 406 and 420 IPC. When the matter came up for hearing, learned Public Prosecutor by producing a copy of the charge sheet submitted that the police have laid charge sheet before IX Metropolitan Magistrate, Miyapur, which was taken cognizance and numbered as C.C.No.555 of 2014 and hence, the instant petition, which is filed for quashment of the proceedings, has became infructuous and prayed to dismiss the petition.

Upon that, learned counsel for the petitioners has made an endorsement on the back of the petition seeking permission of this Court to withdraw the instant petition with a liberty to file afresh petition.

It is seen that pending Criminal Petition, no stay was granted. In view of the above respective submissions, this Criminal Petition is dismissed as infructuous and liberty is given to the petitioners to challenge the charge sheet by initiating appropriate proceedings.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
