HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 29581 OF 2013 ORDER :

When the mater is taken up for hearing, the learned counsel for the petitioner submits that the petitioner was initially appointed as contract labour since 15.4.1993 as Helper and when the case of the petitioner was not being considered for absorption, the petitioner has filed WP 20252 of 1998 along with other contract employees, before this Court seeking absorption in the respondents organization and this Hon'ble Court, vide orders dated 14.10.1998, was pleased to dispose of the writ petition directing the respondents to consider the case of the petitioner for absorption in the respondents organization in terms of B.P.Ms.Nos. 37 and 38, dated 18.5.1977. The learned counsel for the petitioner submits that thereafter the respondents have issued proceedings on 19.11.1998 to the effect that the case of the petitioner would be considered. But, so far, the case of the petitioner has not been considered. Challenging the same, the present writ petition is filed.

The learned counsel for the petitioner submits that, till date, the respondents have not considered the case of the petitioner for absorption and requested that appropriate orders may be passed directing the respondents to absorb the petitioner in the respondents-organization.

The learned Standing Counsel for the respondents contends that appropriate orders would be passed by examining the case of the petitioner.

This Court, having considered the rival submissions is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents seeking absorption within two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with rules within a period of four weeks thereafter.

With this observation, the writ petition is disposed of. The Miscellaneous Petitions pending, if any, shall stand closed. _______________________________ ABHINAND KUMAR SHAVILI, J 19th December, 2018 GS*
