THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.855 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.1 and 2 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.337 of 2015 on the file of Manuguru Police Station, Khammam District, registered for the offences punishable under Sections 307, 294-B and 323 r/w. 34 IPC.

Heard and perused the material available on record. The case of the de facto complainant is that when the 1st petitioner and his wife were quarrelling, the de facto complainant stopped them and thereafter, on 31.12.2015 the petitioners came to the house of the de facto complainant and abused him in filthy language and attacked him with knife and caused bleeding injuries and when the wife of the de facto complainant obstructed them, they also abused her in filthy language and attacked her.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and the de facto complainant is a relative of the wife of the 1st petitioner and they have some family disputes and therefore, the de facto complainant himself attacked the 1st petitioner with a blunt object and the 2nd petitioner rescued him.

Learned Public Prosecutor objected for grant of anticipatory bail to the petitioners since they involved in other cases also. In view of the submission of the learned Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J February 10, 2016 KTL
