THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10598 OF 2015 ORDER:

This criminal petition under Section 482 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking to relax the conditions imposed by the Court of the VII Additional Metropolitan Sessions Judge at Hyderabad, in Crl.M.P.No.2087 of 2015, dated 13.07.2015, which are as follows. "The petitioner/accused No.1 is ordered to be released on bail in the event of his arrest, on his executing bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for like sum to the satisfaction of Station House Officer, WPS., D.D., Hyderabad and that the petitioner shall attend before the concerned Station House Officer, twice in a week i.e., on every Wednesday and Sunday between 9.00 a.m., and 5.00 p.m., until further orders and he is further directed not to leave the city and surrender his passport to police". Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is working as software professional and he needs to visit regularly to foreign countries and if he surrenders passport, the petitioner would lose his employment. He further submits that it is very difficult for the petitioner to get a job in Hyderabad only and as such, the conditions like 'not to leave the city and surrender his passport to the police' may also be relaxed, including the other conditions. Considering the facts and circumstances of the case and also as the offence under Section 498-A IPC, is arising out of matrimonial disputes, except the execution of bond for a sum of Rs.10,000/- with two sureties each for the likesum to the satisfaction of the Station House Officer, WPS., D.D., Hyderabad, all the other conditions are hereby relaxed. The petitioner/A.1 is directed to represent his case before the Court below through his counsel.
