This writ petition is filed under Article 226 of the Constitution of India for the following relief :
"To declare the action of the respondents in allotting the toddy shop to the fifth respondent near Mandamallamma Function Hall, X-road at
Champapet by not considering prescribed norms as illegal, arbitrary and unjust and consequently to direct the respondents not to issue license to the fifth respondent by considering the representation of the petitioner dated 01/09/2015 and to pass such other suitable order as this court may deems fit and proper in the circumstances of the case."
2. Heard Sri M.A. Shakeel, learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise for the respondents 1 to 4.
3. When the matter is called, it is represented by the learned counsel for the petitioner herein that the petitioner herein submitted a representation dated 01/09/2015 to the respondents for redressal of his grievance but no action has been taken till date.
4. Taking into consideration the totality of the circumstances and having regard to the nature of controversy and without expressing any opinion on the merits or demerits, this court deems it appropriate to dispose of this writ petition by directing the respondents herein to take appropriate action and dispose of the representation dated 01/09/2015 submitted by the petitioner herein by fixing some time frame.
5. In view of the above facts and circumstances, this writ petition is disposed of, directing the respondents 2 to 4 to take appropriate action on the representation dated 01/09/2015 said to have been submitted by the petitioner herein in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
6. With the above direction, this writ petition is disposed of at the stage of admission. There shall be no order as to costs.
7. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
