HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1934 of 2016 ORDER:

This Contempt Case is filed alleging non-implementation of the order of this Court in W.P.No.8448 of 2015 dated 27.03.2015. 2.

This Court passed the following order on 27.03.2015 in the aforesaid writ petition filed by the petitioner seeking reappointment as Mini Anganwadi worker: "I have heard the learned Counsel for the petitioner as well as learned Government Pleader for Women Development and Child Welfare appearing for the respondents. However, I do not see any legal right in the petitioner to ask for a direction to the respondents to consider her representation referred to above and inasmuch as the post of Anganwadi worker is now admittedly vacant as the petitioner had resigned earlier. In view of that, any appointment to the said vacant post has to be made only in accordance with law and in that process, the notification has now been issued and published in newspapers on 20.03.2015 and 21.03.2015. If the petitioner is interested for the post, she is at liberty to apply in terms of the said notification and if such an application is received, the same shall be considered by the respondents 2 and 3 along with other eligible candidates."

Now, the learned Counsel for the petitioner submits that even though the petitioner applied for the post of Anganwadi worker

pursuant to the notification, her candidature was not considered by the respondents.

If the candidature of the petitioner was not considered, it creates a fresh cause of action. But, it cannot be termed as violation of the order passed by this Court on 27.03.2015. In the circumstances, this Court sees no ground to entertain the present contempt case.

Accordingly, the Contempt Case is dismissed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ______________________________ A.RAMALINGESWARA RAO, J 14-10-2016 Gsn
