Challa Balaji, v. The State Of Andhra Pradesh,
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.1 1 2 2 3 of 2 0 1 8 ORDER:
This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner, who is A1, in Cr.No.197 of 2018 on the file of the Station House Officer, Sattenapalli Town Police Station, Guntur District. The offence alleged is under Section 420 read Section 34 of the Indian Penal Code. 2.
Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.
3.
The counsel for the petitioner submits that the Court below while dismissing the bail petition directed the police to follow the guidelines issued in ARNESH KUMAR v. STATE OF BI HAR [(2014) 8 SCC 273] . The counsel seeks grant of anticipatory bail with some other stringent conditions.
4.
This Court does not find any reason to interfere with the said order as, as rightly observed by the Court below, the allegations are serious in nature and that there is prima facie material. Hence, this Court is of the opinion that it is not a fit case to grant anticipatory bail to the petitioner.
Hence, the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. __________ T. RAJANI, J November 26, 2018 DSK
