This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, seeking grant of bail to the petitioner, who is A1, in Cr.No.67 of 2017 on the file of the Station House Officer, Yeleswaram Police Station, East Godavari District. The offences alleged are under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

As per the case of the prosecution, the quantity of Ganja involved in this case is 100 Kgs., which is beyond commercial quantity. 4.

The counsel for the petitioner submits that A1 to A3 were already granted bail by this Court. However, A1 was granted interim bail on medical grounds.

Learned Public Prosecutor opposed the bail petition on the ground that the petitioner is a habitual offender and that he is the prime accused.

Hence, considering the nature of the offence and the quantity of ganja involved, this Court is not inclined to grant bail to the petitioner. Hence, the criminal petition is dismissed.
