This writ petition is filed challenging the action of the respondent Nos.2 to 5 in including the land admeasuring Ac.0.81 cents in Survey No.323/1 of Diguvapalli Village, Chowdepalli Mandal in Chittoor District, in prohibitory list. Learned counsel for the petitioner states that without furnishing information with regard to list of prohibited properties, the Sub-Registrar is not receiving the documents for registration and the properties are purely private properties. He also submits that this Court in similar circumstances disposed of several writ petitions directing the Sub-registrars therein to receive and process the documents submitted by the petitioners therein for registration, if the same are in order and the said property is not in the list of prohibited properties as per Section 22 A of the Registration Act.
Heard learned Assistant Government Pleader for Revenue.
In view of the same, this writ petition is disposed of directing the 5th respondent to receive and process the documents presented by the petitioner for registration in relation to the subject property, if the same is in order and is
not in the list of prohibited properties as per Section 22 A of the Registration Act and there is no injunction operating against the properties regarding alienation of the properties. If he wants to refuse registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Act and communicate the same to the petitioner. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 26.10.2018 t k.
