THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46793 of 2016 ORDER:

In this writ petition, the petitioner seeks a direction to the 2nd respondent to dispose of the appeal preferred by the petitioner within a time bound period.

Heard and perused the material available on record. The main case of the petitioner is that being aggrieved by the orders passed by the 3rd respondent in L.T.R.Case No.1/2016/Bym dated 07.10.2016, immediately, he preferred an appeal before the appellate authority i.e. 2nd respondent, along with an application seeking interim relief not to dispossess him from the land in question, but so far, no orders have been passed in the application. Since this Court is not inclined to interfere with the impugned orders of the primary authority-3rd respondent dated 07.10.2016 as the appeal preferred by the petitioner against the said orders is pending with the 2nd respondent, the learned counsel for the petitioner confined his argument to the extent of giving a direction to the 4th respondent not to dispossess the petitioner from the land in question till the 2nd respondent decides the application filed in the appeal for grant of interim relief.

Considering the facts and circumstances of the case, without going into merits of the case, the writ petition is disposed of directing the 2nd respondent to pass orders on the interlocutory application filed by the petitioner along with the appeal as expeditiously as possible, preferably, within a period of three months. Till such time, the 4th

respondent is directed not to dispossess the petitioner from the property in dispute. No costs.
