SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.11229 OF 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/Accused seeking to modify the order, dated 25.06.2018, passed in Crl.M.P. No.593 of 2018 in Crime No.15/RCA-ACB-CIU-VJA/2017 of ACB, CIU, Vijayawada Range, by the learned Special Judge for S.P.E. and A.C.B. Cases, Visakhapatnam, (for short, 'the trial Court') and direct the trial Court to accept substitute sureties in the place of cash sureties. 2.
Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent - State.

By the impugned order, the trial Court allowed the Crl.M.P. No.593 of 2018, on 25.06.2018, and enlarged the petitioner on bail on condition of his executing a personal bond for Rs.5,00,000/- and furnishing two sureties each for a like sum.

Learned Public Prosecutor vehemently opposed the said relief on the ground that the petitioner is a habitual offender and is under the habit of absconding, which is evident from the impugned order. 5.
Hence, for the reasons recorded by the trial Court in the impugned order, this Court opines that it is not safe to permit the petitioner to substitute the sureties in the place of cash sureties.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand dismissed.
