THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 35572 of 2014 O R D E R :

Heard learned counsel for the petitioner as well as learned Assistant Government Pleader for Home.

In this case, the petitioner seeks a mandamus to the 2nd respondent to initiate action against the 5th respondent for causing death of her son.

A counter-affidavit was filed by the Superintendent of Police, Nizamabad denying various allegations. It is not necessary for this Court to record all those averments in the counter-affidavit, as, after taking into consideration the evidence gathered during the investigation and the Dying Declaration recorded by the Magistrate, the case was referred as suicidal death due to petty issues, by the police on 28.10.2014, duly serving notice on the complainant and the final report was submitted. Inasmuch as the investigation is completed and the final report is also filed, the cause in the Writ Petition does not survive any further. If the petitioner has any grievance with respect to the final report, it is for her to take necessary steps in accordance with law.

The Writ Petition is therefore, closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
